1. Acceptance of the Terms
These Terms and Conditions ("Terms") govern access to and use of the services of Netsocs LLC ("Netsocs", "we", "us"), including our websites, software-as-a-service (SaaS) platforms, and the Firebot Suppression mobile application (collectively, the "Services").
By accessing, registering for, or using the Services, you agree to be bound by these Terms. If you do not agree to them, you must not access or use the Services. We reserve the right to update these Terms at any time; continued use of the Services after a modification constitutes acceptance of the changes.
2. Description of the Service
The Services enable the management and monitoring of fire safety and water leak detection devices installed in properties, organized by companies, communities, buildings, and units. Features include, among others: device status visualization, real-time alerts and notifications, contact management, and property administration.
Access to the Services requires an account authorized by the corresponding organization and may be subject to separate commercial agreements between Netsocs and that organization.
3. Important Notice — Not an Emergency System
THE SERVICES ARE A SUPPLEMENTARY MONITORING AND NOTIFICATION TOOL. THEY DO NOT REPLACE CERTIFIED ALARM SYSTEMS, FIRE SUPPRESSION SYSTEMS, PROFESSIONAL MONITORING SERVICES, OR EMERGENCY SERVICES.
DELIVERY OF PUSH NOTIFICATIONS, EMAILS, AND ALERTS DEPENDS ON FACTORS BEYOND OUR CONTROL, INCLUDING INTERNET CONNECTIVITY, THIRD-PARTY MESSAGING SERVICES, YOUR MOBILE DEVICE CONFIGURATION, AND SENSOR STATUS. WE DO NOT GUARANTEE THAT ALERTS WILL BE DELIVERED IN A TIMELY, UNINTERRUPTED, OR ERROR-FREE MANNER.
IN THE EVENT OF AN EMERGENCY, ALWAYS CONTACT YOUR LOCAL EMERGENCY SERVICES IMMEDIATELY (FOR EXAMPLE, 911).
4. Eligibility and Account Registration
You must be at least 18 years old to use the Services. If you use the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
By creating an account, you agree to:
- Provide truthful, current, and complete information during registration
- Maintain and promptly update your account information
- Protect the confidentiality of your access credentials
- Take responsibility for all activities performed from your account
- Notify us immediately of any unauthorized use of your account
5. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. The following is prohibited:
- Violating applicable laws or regulations
- Infringing the intellectual property rights of third parties
- Transmitting malicious code, viruses, or harmful content
- Attempting to gain unauthorized access to our systems, networks, or devices
- Interfering with the operation of the Services, servers, or connected sensors
- Tampering with, disabling, or altering monitoring devices without authorization
- Using automated systems to access the Services without permission
- Impersonating any person or entity
- Collecting information from other users without their consent
6. Devices and Monitoring Data
The Services process telemetry data generated by physical devices (water leak sensors, valves, communication gateways, and related equipment). The proper functioning of the Services depends on the adequate installation, maintenance, power supply, and connectivity of those devices, which are the responsibility of the owner or operator of the facility.
The "online" or "offline" status and the battery levels shown in the application reflect the last information received and may not represent the actual, immediate state of the device.
7. Notifications and Communications
By using the Services, you agree to receive push notifications, emails, and other communications related to your devices' events and the administration of your account. You can manage notification permissions from your mobile device settings; disabling them may prevent you from receiving safety alerts.
8. Intellectual Property
The Services, including all of their content, features, trademarks, and software, are the property of Netsocs or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Firebot Suppression application on your personal devices, solely to access the Services in accordance with these Terms.
You may not copy, modify, distribute, sell, lease, reverse engineer, or decompile any part of the Services, except to the extent expressly permitted by applicable law.
9. Third-Party Services
The Services may integrate with or depend on third-party services (for example, cloud infrastructure providers, push messaging services, and app stores). Netsocs is not responsible for the content, privacy practices, or availability of such third-party services. Your use of the application may also be subject to the terms of the app store from which you downloaded it (Google Play or the App Store).
10. Privacy
The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms.
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. NETSOCS DISCLAIMS ALL WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
NETSOCS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NETSOCS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR GOODWILL, OR FOR PROPERTY DAMAGE OR PERSONAL INJURY ARISING FROM THE NON-DELIVERY OR DELAYED DELIVERY OF ALERTS OR NOTIFICATIONS, ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICES.
IN NO EVENT SHALL NETSOCS' TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO NETSOCS DURING THE TWELVE MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless Netsocs and its officers, employees, and agents from any claim, liability, damage, loss, or expense arising from: (a) your use of the Services; (b) your breach of these Terms; or (c) your violation of third-party rights.
14. Suspension and Termination
We reserve the right to suspend or terminate your account and your access to the Services, at our sole discretion and without prior notice, for conduct that we believe violates these Terms, may harm Netsocs or other users, or exposes us to legal liability.
Upon termination, your right to use the Services will cease immediately. Provisions that by their nature should survive (including, among others, intellectual property, warranty disclaimers, and limitations of liability) will remain in effect.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Netsocs is registered, without regard to its conflict of law rules. Any dispute arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the arbitration association of that jurisdiction.
16. Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Continued use of the Services after such changes constitutes your acceptance of the new Terms.
